Judge on Monday rejected the trial of the Sean Diddy Combso criminal sex.
Juror No. 6, 41-year-old black, who said he was a 90s hip-hop and reggaetone fan, US District Judge ARUN Subramanian, after the judge said he had doubts about the attribution statements.
Subramanian said he was concerned with swearing, trying to capture his answers to remain sworn in the Hip-Hop-Mogul Federal Court in Manhattan.
“There are serious questions about the sincerity of the jurors and the ability of the sworn person to follow the court’s instructions,” Subramanian said on Friday.
The man was one of three jurors who claimed they liked hip -hop.
The juror was replaced by a sworn person, a 57 -year -old white father from Westchester. The new jurors stated during the jury that it was partially 70 in fun and classic jazz and that his son “attracted me aside”.
The jury now has four black jurors, not the initially elected five.
The removal of the sworn person to the judge through Voir Dir said he lives in Bronks with his girlfriend and their daughter. However, during the trial, he announced that he had moved to new Jersey to the court.
A court worker drew this information on Subramanian’s attention.
At least two closed door sessions last week was the sworn person no. 6 was asked to find out where he lived. He continued to provide inconsistent answers when the judge questioned in front of the parties and for the presence of other jurors or society.
Despite the repeated objections of the Combs defense lawyers, the sworn person said he was a racist to remove the black junction and replace him with white.
Combs lawyer Xavier Donaldson on Friday asked the judge to attract youor no. 6 to explain his discrepancies again, but the judge refused to say that he had already been interviewed twice.
“I think this is extremely important, sometimes above all else, that we have a jurors who reflect what they make decisions with, especially in this city,” Donaldson said.
None of the parties said that the initial sworn person no. 6 should be removed from the jurors due to its residency. These were the inconsistent claims of the man who raised the red flag to the judge.
“Even if, as a technical matter, this sworn person would be qualified to be sworn, it is that changing answers and inconsistency cause the court to worry about deception and lies,” Subramanian said Friday.
On Monday, the judge said defense and prosecution that racism had nothing to do with the removal of jurors. The judge added that he would be a racist instead if he was followed by jurors for diversity, despite the inconsistent jurors.
The former sworn person had experience with the criminal justice system. He said he worked in a city -controlled prison in Manhattan.
He also said he had previously admitted guilty of improper insurance fraud associated with his search for physical therapy after a car disaster.
